Opinion PHILLIPS, Senior Circuit Judge: Willard M. Toler, a retired coal miner, seeks review of a decision and order of the Benefits Review Board (Board) affirming the administrative law Judge's (ALJ) denial of benefits under the Black Lung Benefits Act, 30 U.S.C. §§ 901 -945 (Act). Toler argues that the ALJ's finding that he failed to establish a total disability due to pneumoconiosis, as required by 20 C.F.R. § 718.204, was not based on substantial evidence. The Director, Office of Workers' Compensation Programs (Director), nominally a respondent, concurs. We agree. Accordingly, we vacate the Board's order and remand for further proceedings.
